Welcome to Hollis Health. By accessing our website or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our services. If you do not agree to these terms, please do not use our website or services.

Terms of Service
Effective Date: March 4, 2026
These Terms of Service (the "Terms") form a legally binding agreement between you ("Member," "you," or "your") and Hollis Health LLC, a Texas limited liability company ("Hollis Health," "Company," "we," "us," or "our"), governing your access to and use of our consultations, memberships, facilities (if and when made available to you), digital platforms, supplement program, and related services (collectively, the "Services").
BY ENROLLING, ACCESSING THE SERVICES, OR CLICKING OR SIGNING AN ACCEPTANCE, YOU AGREE TO THESE TERMS AND TO ANY POLICIES OR SIGNED MEMBERSHIP DOCUMENTS THAT THEY INCORPORATE. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
These Terms are intended to work together with the signed Membership Agreement, the Privacy Policy, the Health Data Privacy Notice, and the Cancellation and Refund Policy. If there is a conflict between these Terms and your signed Membership Agreement on a specific commercial point such as your tier, contract length, pricing, or add-ons, the signed Membership Agreement controls for that point.
1. Description of Services
Hollis Health provides a membership-based wellness and health optimization program that may include some or all of the following categories of services, depending on your signed Membership Agreement, elected tier, approved add-ons, availability, and any third-party clinical arrangements applicable to you.
1.1 Wellness Programming. Personal training, fitness programming, recovery protocols, habit coaching, education, and related wellness support.
1.2 Nutrition and Lifestyle Support. Nutrition guidance, meal logging, behavioral coaching, and general lifestyle support intended for wellness purposes.
1.3 Recovery Modalities. Access to modalities such as infrared sauna, cold water immersion, and red light therapy, where offered and where you have completed all required screening, waiver, and facility procedures.
1.4 Digital Tools. Access to our mobile application, member portal, dashboards, scheduling tools, messaging features, supplement ordering tools, and related digital services.
1.5 Care Coordination and Administrative Support. Administrative coordination with independently licensed physicians, laboratories, imaging providers, pharmacies, and other third parties involved in your program, where applicable.
1.6 Clinician-Supervised or Third-Party Services. Certain programs may include access to or coordination for services that are ordered, supervised, interpreted, dispensed, or provided by independently licensed physicians, laboratories, or other third parties. Unless your signed Membership Agreement expressly states that a given third-party charge is included, those third-party services may be billed separately.
2. Important Medical and Regulatory Disclosures
2.1 Hollis Health Is Not Your Physician. Hollis Health is not a hospital, physician practice, emergency service, or licensed medical clinic. Hollis Health does not itself diagnose disease, prescribe medication, or provide medical treatment.
2.2 Independent Clinical Providers. Any physician, laboratory, imaging provider, pharmacy, or other clinical provider associated with your program acts in its own licensed capacity and remains independently responsible for its own clinical judgment, legal compliance, and patient documentation.
2.3 No Emergency Services. The Services are not intended for emergency use. If you believe you are experiencing a medical emergency, call 9-1-1 or go to the nearest emergency room immediately.
2.4 Wellness Tools, Not Medical Devices. Our digital tools are intended to support wellness engagement, coordination, and information display. They are not a substitute for physician judgment or emergency care.
2.5 Consult a Qualified Clinician. You should consult a qualified licensed clinician before starting a new exercise program, recovery modality, supplement regimen, major nutrition change, or any activity that may affect your health.
3. Eligibility and Account Responsibilities
3.1 Adult Use. Memberships are intended for adults unless Hollis Health expressly offers a separate minor-access workflow with additional consent and documentation requirements.
3.2 Accurate Information. You agree to provide accurate, current, and complete information and to update it when needed.
3.3 Security of Credentials. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account.
3.4 Compliance With Policies. You agree to comply with applicable laws, facility rules, safety instructions, and all policies incorporated into these Terms.
3.5 No Misuse. You may not misuse the Services, including by sharing credentials, bypassing billing obligations, harassing personnel, scraping data, or accessing systems or records that are not yours.
4. Membership Structure and Commercial Terms
4.1 Signed Membership Agreement Controls. Your signed Membership Agreement controls your elected membership tier, term, pricing, add-ons, included benefits, payment method authorization, and any separately billed services.
4.2 Not Every Service Is Included in Every Membership. Public descriptions of the Services describe the Hollis Health program generally. The exact mix of included services varies by signed membership package. No website copy, sales conversation, deck, or marketing material overrides the written commercial terms in your signed Membership Agreement.
4.3 Third-Party Clinical Charges. Laboratory testing, imaging, clinician consultations, prescriptions, and other third-party clinical services may be billed separately by the applicable third party unless expressly included in your signed Membership Agreement or written package summary.
4.4 Payment Authorization. You authorize Hollis Health and its payment processor to charge your approved payment method for amounts due under your signed Membership Agreement, including recurring membership charges, approved add-ons, supplements, taxes where applicable, late fees where lawful, and other authorized amounts.
4.5 Auto-Renewal. If your signed Membership Agreement includes auto-renewal, renewal will occur in accordance with that agreement and applicable law. Hollis Health may provide reminder notices as described in the signed agreement or applicable policy.
4.6 Failed Payments and Suspension. If a payment fails, we may retry the charge, contact you for updated payment information, suspend access to some or all Services, or pursue other remedies allowed by your signed agreement and applicable law.
5. Assumption of Risk and Separate Waivers
Physical activity, training, recovery modalities, supplement use, and health-related services involve risk. Your participation is conditioned on your completion of the separate waiver, screening, and consent documents that Hollis Health requires for the applicable activities.
Those separate documents may include a liability waiver, informed consent, communications consent, and other safety-related or legal acknowledgments. If you do not complete required documentation, Hollis Health may refuse or suspend access to the affected Service.
6. Intellectual Property
6.1 Company Property. The Services, software, content, branding, programs, frameworks, and other materials provided by Hollis Health are owned by Hollis Health or its licensors and are protected by intellectual property laws.
6.2 Limited License. Subject to these Terms and your payment and compliance obligations, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use.
6.3 Restrictions. You may not copy, reverse engineer, resell, sublicense, or commercially exploit the Services or related materials without our prior written consent.
6.4 User Submissions. If you submit content to us, you grant us the limited rights reasonably necessary to host, process, display, transmit, and use that content to provide and improve the Services, subject to our Privacy Policy and applicable law.
7. Disclaimers
7.1 No Guarantee of Outcome. We do not guarantee weight loss, lab improvement, symptom improvement, performance gains, medical outcomes, insurance savings, or any other specific result.
7.2 Services Provided "As Available." To the fullest extent permitted by law, the digital portions of the Services are provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation.
7.3 No Advice Beyond the Scope of the Service. Nothing in the Services is intended to replace independent medical, legal, tax, or financial advice.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- Hollis Health is not liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to the Services;
- Hollis Health is not responsible for acts, omissions, diagnoses, treatment decisions, or billing determinations of independent third-party providers;
- Hollis Health's aggregate liability for claims arising out of these Terms or the Services will not exceed the greater of: (a) the amounts you paid directly to Hollis Health in the three (3) months preceding the event giving rise to the claim; or (b) any minimum amount that must be preserved under applicable law.
Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Hollis Health and its affiliates, managers, officers, employees, contractors, agents, successors, and assigns from third-party claims arising out of your unlawful conduct, misuse of the Services, breach of these Terms, fraudulent chargebacks, or infringement of third-party rights.
10. Termination
10.1 Termination by You. You may cancel your membership or other Services in accordance with your signed Membership Agreement and the Cancellation and Refund Policy.
10.2 Termination by Hollis Health for Cause. We may suspend or terminate access if you materially breach these Terms or related policies, engage in harassment or abusive conduct, threaten safety, misuse the platform, engage in fraud, or fail to cure a payment default where cure is required.
10.3 Termination by Hollis Health Without Cause. Where permitted by your signed agreement, Hollis Health may terminate the relationship on advance written notice. If we terminate a membership without cause, any refund obligations are governed by your signed agreement and the Cancellation and Refund Policy.
10.4 Survival. Provisions that by their nature should survive termination will survive, including payment obligations, dispute resolution, intellectual property protections, indemnification, and limitations of liability.
11. Dispute Resolution
11.1 Arbitration. Except where prohibited by law or where a signed agreement provides otherwise, disputes arising out of or related to the Services shall be resolved by binding arbitration on an individual basis.
11.2 Forum and Rules. Arbitration will be conducted before the American Arbitration Association under the rules applicable to the dispute type, and may be conducted in Bexar County, Texas, or by remote means where appropriate.
11.3 Small Claims and Injunctive Relief. Either party may bring an individual claim in small claims court if eligible. Either party may seek temporary or injunctive relief in court to protect confidential information, intellectual property, account security, or other rights requiring immediate relief.
11.4 Class Action Waiver. To the fullest extent permitted by law, disputes must be brought on an individual basis and not as a class, collective, coordinated, or representative action.
11.5 Opt-Out. If a signed agreement or notice gives you an arbitration opt-out right, you must exercise it in the manner and within the time stated there.
12. Texas Membership Disclosures
If your membership is governed by Texas health-spa law, your signed Membership Agreement and any applicable addendum will include the disclosures, cancellation rights, and notices applicable to your program and the facility status at the time of sale.
Nothing in these Terms waives any non-waivable consumer protection rights that apply to you.
13. Chargebacks and Payment Disputes
If you believe a charge is unauthorized or incorrect, you agree to contact Hollis Health first so that we can investigate and attempt to resolve the issue promptly.
This provision does not waive any non-waivable consumer rights. However, frivolous, abusive, or bad-faith chargebacks may constitute a material breach of these Terms and of your signed Membership Agreement.
14. Changes to the Services and Terms
Hollis Health may change the Services, features, vendors, facilities, pricing for future terms, policies, or these Terms from time to time. Material changes will be communicated in a manner reasonably calculated to provide notice, and any change subject to additional legal requirements will be handled in accordance with those requirements.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent superseded by federal law or non-waivable consumer protection law.
